Why fatal crash reports take longer — and what to do while you wait

After an ordinary fender-bender, a police report might be ready in a week or two. After a fatal collision, families are often told the report is "still open" for months — usually with no explanation of why. Here is what's actually happening.

Fatal crashes get a different investigation

The investigating agency may need scene reconstruction, vehicle inspections, event-data-recorder downloads, toxicology, witness interviews, or review by a specialized team. The agency may withhold some or all material while an investigation is active or when another legal restriction applies.

What that means for timing

Timing varies from weeks to months or longer. A complex investigation or possible criminal case may delay completion or limit what can be released. The agency's current status estimate is the best source for a particular report.

Who can request it

Vehicle Code §20012 limits disclosure of collision reports to people with a proper interest, including specified drivers, owners, property owners, injured persons, and certain representatives. Whether a particular relative or representative qualifies depends on the facts and the agency's documentation requirements. Fees vary by agency.

What to do while you wait

Records timing and legal deadlines are separate. Code of Civil Procedure §335.1 provides a general two-year period for certain actions for a death caused by wrongful act or neglect. Government Code §911.2 generally requires certain death or injury claims against a public entity within six months after accrual. Exceptions and other rules may apply.
